Maryland man alleges Burton Neil & Associates incorrectly listed address in suit

PHILADELPHIA – A Maryland consumer alleges a West Chester debt collector used false and misleading means in an attempt to collect an alleged debt.

James Eugene Thomas filed a complaint on Oct. 28 in the U.S. District Court for the Eastern District of Pennsylvania against Burton Neil & Associates PC citing the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that in October, the defendant filed a suit against him Juniata County Court of Common Pleas that incorrectly listed him as a resident of Mifflintown. He alleges he challenged the venue because of this information and the defendant later filed a praecipe to discontinue the action.

The plaintiff holds Burton Neil & Associates PC responsible because the defendant's actions caused him emotional distress, inconvenience, embarrassment and humiliation.

The plaintiff requests a trial by jury and seeks actual damages, statutory damages in the amount of $1,000, court costs and any further relief the court grants. He is represented by Michael P. Forbes of Law Office of Michael P. Forbes PC in Wayne.
