Caliber Home Loans accused of violating debt collection law

PHILADELPHIA — A married couple's lawsuit against Caliber Home Loans Inc. alleges misrepresentation in debt collection.

Gerald D. Dunlap Jr. and Nancy J. Dunlap filed a complaint on Oct. 31 in the U.S. District Court for the Eastern District of Pennsylvania against Caliber Home Loans Inc., alleging that the debt collector committed a series of acts mishandling the plaintiffs' mortgage debt in connection with their Chapter 13 banktruptcy.

According to the complaint, the plaintiffs allege that Caliber incorrectly claimed they were in arrears and made threats related to foreclosure. The plaintiffs hold Caliber Home Loans Inc. responsible because the defendant allegedly failed to review the plaintiffs' account.

The plaintiffs seek actual damages, statutory damages, punitive damages, court costs and any further relief this court grants. They are represented by Robert P. Cocco of Robert P. Cocco, P.C. in Philadelphia.
