Bookkeeper alleges Cherry Scaffolding Inc. terminated her in retaliation

PHILADELPHIA – A Levittown woman alleges a Bensalem business wrongfully terminated her from her position as a bookkeeper.

Linda Sondesky filed a complaint on Oct. 31 in the U.S. District Court for the Eastern District of Pennsylvania against Cherry Scaffolding Inc. and Stephen Ellis alleging violation of the Fair Labor Standards Act and the Pennsylvania Wage Collection and Payment Act.

According to the complaint, the plaintiff was employed by the defendants from October 2015 until March. The plaintiff alleges that she was terminated from her employment for complaining about not being fairly compensated for her work. The plaintiff holds Cherry Scaffolding Inc. and Ellis responsible because the defendants allegedly refused to pay overtime premiums to the plaintiff for working more than 40 hours per week.

The plaintiff requests a trial by jury and seeks compensatory damages, injunctive and declaratory relief, liquidated damages, punitive damages, court costs and any further relief the court grants. She is represented by W. Charles Sipio, Timothy M. Kolman and Wayne A. Ely of Kolman Ely PC in Penndel.
