Aetna Life Insurance Company, others accused of wrongly denying disability benefits

PITTSBURGH — A woman is suing Aetna Life Insurance Company, The Bank of America Corporate Benefits Committee and The Bank of America Corporation Long Term Disability Plan, alleging breach of contract.

Joanne Desue filed a complaint on Oct. 31 in the U.S. District Court for the Western District of Pennsylvania against the defendants, alleging that they wrongly terminated her disability benefits.

According to the complaint, the plaintiff alleges that in 2013, she became disabled and was being paid disability benefits until the payments were terminated. The plaintiff holds the defendants responsible because her benefits were allegedly terminated despite the existence of sufficient medical evidence to support her claim.

The plaintiff seeks payment of all benefits plus interest, restitution or surcharge, court costs and any further relief this court grants. She is represented by Tybe A. Brett and Ruairi McDonnell of Feinstein Doyle Payne & Kravec, LLC in Pittsburgh.
