After four weeks at BJ's Restaurants, man files class action

PITTSBURGH — A man who worked about four weeks as a server has filed a class action lawsuit against BJ's Restaurants Inc., his former employer, alleging violation of wage laws.

Tyler Smith filed a complaint on Oct. 31 in the U.S. District Court for the Western District of Pennsylvania against BJ's Restaurants Inc. alleging that the employer failed to fairly compensate the plaintiff.

According to the complaint, the plaintiff alleges that he was required to spend part of his time as a "food runner," receiving sub-minimum wage with no tips. He holds BJ's Restaurants Inc. responsible for allegedly violating minimum wage standards.

The plaintiff requests a trial by jury and seeks unpaid wages, interest, liquidated damages, court costs and any further relief this court grants. He is represented by D. Aaron Rihn of Robert Peirce & Associates, P.C. in Pittsburgh and Nicholas A. Migliaccio and Jason S. Rathod of Migliaccio & Rathod, LLP in Washington.
