Taylor's Bar & Grill alleged to have performed songs without authorization

SCRANTON – A Unityville restaurant is accused of using certain music without a license or authorization.

Broadcast Music Inc.; Less Than Zero Music; Southfield Road Music; Fake and Jaded Music; Embassy Music Corp.; E.O. Smith Music; Tentative Music Inc.; Sony/ATV Songs LLC; House of GAGA Publishing LLC; Redone Production LLC, doing business as Songs of Redone, filed a complaint on Nov. 4 in the U.S. District Court for the Middle District of Pennsylvania against McCarty's Finish Line Inc., doing business as Taylor's Bar & Grill, and Keith T. Hyndman alleging that they used plaintiff's musical compositions without permission.

According to the complaint, the plaintiffs allege that they sustained damages to their business. The plaintiffs holds McCarty's Finish Line Inc. and Hyndman responsible because the defendants allegedly failed to respond to plaintiffs' cease and desist letters and continued to use plaintiffs' musical compositions without acquiring a license from the plaintiff.

The plaintiffs seek to enjoin the defendants from further infringing plaintiffs' copyrights, pay statutory damages, court costs and any further relief the court grants. They are represented by Kenneth J. McDermott II of Tuckey Arensberg PC in Lemoyne.
