Wells Fargo Bank claims heirs failed to make mortgage payments

PITTSBURGH — A financial institution is suing unknown heirs, successors, assigns, and all persons, firms, or associations claiming right, title or interest from or under Theola Thrash, alleging breach of contract and unpaid debt.

Wells Fargo Bank, NA s/b/m to Wells Fargo Home Mortgage Inc. filed a complaint on Oct. 20 in the Court of Common Pleas of Allegheny County against the defendants, alleging that they failed to make payments on a mortgage.

According to the complaint, the plaintiff alleges that it suffered monetary damages. The plaintiff holds the defendants responsible because they allegedly let the mortgage go into default.

The plaintiff seeks judgment against the defendants in the amount of $42,771.67 plus interest, court costs and the foreclosure and sale of the mortgaged premises. They are represented by Elizabeth M. Bennett of Phelan Hallinan Diamond & Jones, LLP in Philadelphia.
