Forbes Regional Hospital, others accused of negligence in child's care

PITTSBURGH — The parents of a minor are suing West Penn Allegheny Health System Inc., d/b/a Forbes Regional Hospital; Jadyn Swerbinsky, P.A.; Alyssa B. Rotolo, M.D.; Emergency Medical Physicians of Allegheny County Ltd.; Clare W. Budd, D.O.; Ken Gibson, M.D.; and UPMC Community Medicine Inc., d/b/a Partners in Health-UPMC, alleging negligence in medical care.

Tiffany Jolayemi, a minor, by her parents and natural guardians Frances Jolayemi and Timothy Jolayemi, filed a complaint on Oct. 24 in the Court of Common Pleas of Allegheny County against the defendants, alleging that they failed to provide proper medical care to Tiffany Jolayemi.

According to the complaint, the plaintiffs allege that Tiffany Jolayemi sustained physical injuries including the development of foot drop. The plaintiffs hold the defendants responsible because they allegedly failed to properly diagnose Tiffany Jolayemi's condition and provide the necessary treatment.

The plaintiffs request a trial by jury and seek judgment against the defendants in an amount in excess of $50,000. They are represented by Alan H. Perer of Swensen & Perer in Pittsburgh.
