PHILADELPHIA — A former employee is suing Jay's Pub LLC, d/b/a Growler's, d/b/a La Casa De Tu Madre; Jason Evenchik; and Joshua McCullough, alleging that the employers violated wage laws and terminated him for requesting accommodations and workers' compensation benefits after a workplace accident that damaged his vision.
Joel Stuart filed a complaint on Nov. 23 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants, alleging violation of overtime provisions and the Americans with Disabilities Act, among others.
According to the complaint, the plaintiff alleges that he worked for more than 40 hours per week without being paid any overtime, and that he was discharged after seeking accommodation and and Workers' Compensation for a workplace injury. The plaintiff holds the defendants responsible for allegedly violating several federal and state laws in their conduct toward him and his compensation.
The plaintiff requests a trial by jury and seeks damages, economic damages, court costs and any further relief this court grants.
