United Chemi-Con accused of breaching contract, warranty

PITTSBURGH -- A Pennsylvania business is suing United Chemi-Con Inc., an Illinois corporation, citing alleged breach of contract and breach of warranty.

Bombardier Transportation Holdings USA Inc. filed a complaint on Dec. 22 in the U.S. District Court for the Western District of Pennsylvania against United Chemi-Con, alleging the company advertised capacitors it sold to the plaintiff as being designed to last 15 years, but that the capacitors began failing far earlier than that.

According to the complaint, Bombardier alleges it suffered monetary damages due to the cost of replacing the capacitors that failed in railcars in which Bombardier had supplied the propulsion system utilizing the capacitors. The plaintiff holds United Chemi-Con Inc. responsible because the defendant allegedly failed and refused to provide a remedy for the defective capacitors it provided the plaintiff.

The plaintiff seeks judgment against the defendant in an amount that exceeds $75,000 plus interest, court costs and any further relief this court grants.

The plaintiff is represented by William D. Clifford and Christopher A. Lovato of Dickie, McCamey & Chilcote P.C. in Pittsburgh.
