PHILADELPHIA -- A Pennsylvania business is suing Sabatino Bianco, a Texas doctor, requesting a declaratory judgment on two products at the heart of a dispute.

Globus Medical Inc. filed a complaint on Dec. 22 in the U.S. District Court for the Eastern District of Pennsylvania against Bianco, seeking clarification in a matter stemming from a royalty case.

According to the complaint, Globus alleges it has been threatened with the possibility of litigation by Bianco. The plaintiff holds Bianco responsible because the defendant allegedly claims that Globus failed to pay required royalties.

Globus requests a trial by jury and seeks a declaration that its products are more than colorably different from the products subject to royalties. It is represented by Jeffrey S. Cianciulli of Weir & Partners LLP in Philadelphia.
