Avenue Kitchen, others accused of violating minimum wage laws

PHILADELPHIA -- A man has filed a class action lawsuit against former employers Local At Villanova LLC, doing business as Avenue Kitchen; Local at Glen Mills LLC, doing business as Avenue Kitchen; Dana Smith Farrell and Doe defendants 1-10, alleging violation of federal and state wage laws.

Lester A. Walsh filed a complaint on Dec. 22 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants, alleging they failed to pay fair compensation through incorrect application of a tip credit and deductions from wages.

According to the complaint, Walsh alleges his rate of pay violated the Fair Labor Standards Act and the Pennsylvania Minimum Wage Act. He holds the defendants responsible for allegedly underpaying him and for also allegedly violating the Pennsylvania Wage Payment and Collection Law by making unlawful deductions from wages.

Walsh requests a trial by jury and seeks injunction against the defendant, unpaid minimum wages, liquidated damages, court costs and any further relief this court grants. He is represented by Gerald D. Wells III and Robert J. Gray of Connolly Wells & Gray LLP in King of Prussia and Michael K. Yarnoff of Kehoe Law Firm P.C. in Philadelphia.
