Life Insurance Co. of North America alleged to have wrongfully terminated disability benefits

PHILADELPHIA – A Spring City woman alleges her disability benefits were wrongfully terminated.

Deann Lowary filed a complaint on Dec. 19, 2017, in the U.S. District Court for the Eastern District of Pennsylvania against Life Insurance Co. of North America alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff filed for short-term disability benefits twice with the defendant and both were approved. The suit states she was to transition to long-term disability benefits in March 2016, but the defendant retroactively terminated her short-term disability benefits the same month.

The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly failed to fully review her claim.

The plaintiff seeks payment of disability benefits, interest, court costs and any further relief the court grants. She is represented by Joseph Capitan of Abell & Capitan Law in Philadelphia.
