PHILADELPHIA – A restaurant with a registered office in Moosic is alleged to have failed to pay its employees the correct overtime rate.

United States Department of Labor Secretary of Labor R. Alexander Acosta filed a complaint on Dec. 22, 2017, in the U.S. District Court for the Middle District of Pennsylvania against Matteo Inc., doing business as Nonno's Pizza and Family Restaurant, and Matthew Basile, individually and as president and an owner of the aforementioned company, citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that the defendants failed to pay its employees at a rate of time-and-one-half of their regular rate for hours worked over 40 per week from a period of August 2014 to August 2017. The plaintiff also alleges that the defendants failed to maintain employee time records for two years.

The plaintiff seeks to enjoin the defendants, find the defendants liable for all unpaid overtime compensation, liquidated damages, court costs and any further relief the court grants. He is represented by Nicholas C. Geale, Oscar L. Hampton III, Adam F. Welsh and John A. Nocito of Office of the Solicitor Region III in Philadelphia.
