Couple seeks damages after husband was injured by fan housing manufactured by Gibraltar Industries

SCRANTON – A Saylorsburg couple alleges the sharp edge of a fan housing caused severe injuries to the husband.

Justin Bernard and Amanda Bernard filed a complaint on Dec. 20, 2017, in the U.S. District Court for the Middle District of Pennsylvania against Gibraltar Industries and Air Vent Inc. alleging strict liability, negligence and other counts.

According to the complaint, Justin Bernard severely lacerated his left middle finger while opening the packaging of a solar-powered attic fan manufactured by the defendants on March 22, 2016. The suit states the bottom edge of the fan housing was in a dangerously sharp condition.

The plaintiffs hold Gibraltar Industries and Air Vent Inc. responsible because the defendants allegedly distributed and assembled the fan in a defective and dangerous condition.

The plaintiffs request a trial by jury and seek judgment against the defendant in an amount of more than $75,000 plus interest, court costs and any further relief the court grants. They are represented by Anthony J. Baratta of Baratta, Russell & Baratta in Huntingdon Valley.
