PHILADELPHIA – A New Jersey company is alleged to owe more than $80,000 to Philadelphia-based employee benefit plans.
International Union of Painters and Allied Trades District Council No. 21 Health and Welfare Fund, et al. filed a complaint on Jan. 10 in the U.S. District Court for the Eastern District of Pennsylvania against Eastern Solar Glass Inc. citing the Labor Management Relations Act and the Employee Retirement Income Security Act.
According to the complaint, International Union of Painters and Allied Trades District Council No. 21 and the defendant are parties to a bargaining agreement. The plaintiffs allege that an audit of the defendant's records was conducted in July 2017 and found that from a period of January 2014 to December 2016, a delinquency of $80,268.37 is owed.
The plaintiffs seek the amount found due and owing, an accounting and audit of all amounts due, interest, court costs, injunctive relief, liquidated damages and any further relief the court grants. They are represented by Nicholas J. Botta of Spear, Wilderman PC in Philadelphia.
