Overland & Associates Inc. alleged to have failed to pay contributions to benefit plan

PHILADELPHIA – A multiemployer employee benefit plan headquartered in Newton Square allege that a Texas company failed to remit employee contributions.

Trustees of the National Elevator Industry Pension, et al. filed a complaint on Jan. 8 in the U.S. District Court for the Eastern District of Pennsylvania against Overland & Associates Inc. and Laura Willingham citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that they the audited the defendants' records for a period of January 2013 to July 2014 and found delinquencies.

The plaintiffs hold Overland & Associates Inc. and Willingham responsible because the defendants allegedly failed to remit their employees' contribution based on their bargaining agreement.

The plaintiffs seek $52,984.55 in estimated contributions, $1,400.25 for contributions and interest found due by the audit and any other relief the court may deem appropriate. They are represented by Robert P. Curley and David D. Capuano of O'Donoghue & O'Donoghue LLP in Philadelphia.
