Three Pennsylvania restaurants cited by labor secretary for alleged FLSA violations

PHILADELPHIA – Three restaurants and their owners are alleged to have failed to pay employees a minimum wage or overtime premiums.

Secretary of Labor of the United States Department of Labor R. Alexander Acosta filed a complaint on Jan. 9 in the U.S. District Court for the Eastern District of Pennsylvania against El Guerrero Inc.; doing business as Cancun Mexican Restaurant; Los Hidalguenses Inc., doing business as La Hacienda Restaurant; Rey Azteca of Warminster Inc., doing business as Rey Azteca Restaurant; Ramiro Palacios; and Ramiro Palacios-Olguin citing the Fair Labor Standards Act.

According to the complaint, the defendants alleged failed to pay servers, hostesses, bussers, cooks and dishwashers the statutory minimum wage rate and also allegedly failed to pay employees overtime premiums.

The plaintiff seeks injunction against the defendants, enjoin the defendant, unpaid minimum wages and overtime compensation. He is represented by Nicholas C. Geale, Oscar L. Hampton III, Adam Welsh and Andrea Luby of Office of the Solicitor, Region III in Philadelphia.
