READING – A Bucks County man is challenging an insurance company's denial of long-term disability benefits.
Barry Berger filed a complaint on Jan. 11 in the U.S. District Court for the Eastern District of Pennsylvania against Cigna Health and Life Insurance Co. alleging that the insurance company failed to pay plaintiff's claim for benefits.
According to the complaint, the plaintiff alleges that he became disabled from his job with Amtrak in November 2016 as the result of having symptoms associated with alcoholic cirrhosis of the liver. The suit states he received short-term disability benefits but his claim for long-term disability benefits was denied by the defendant.
The plaintiff holds Cigna Health and Life Insurance Co. responsible because the defendant allegedly denied plaintiff's claim for long-term disability benefits despite having sufficient medical proof to validate his claim for disability.
The plaintiff seeks judgment against the defendant for compensatory damages in an amount of more than $150,000 plus interest and court costs. He is represented by Brandon A. Swartz and Larissa K. Staszkiw of Swartz Culleton PC in Newtown.
