Armstrong County Memorial Hospital seeks to vacate arbitration award

PITTSBURGH – A Kittanning hospital is asking a court to overturn an arbitration opinion in a grievance with a union.

Armstrong County Memorial Hospital filed a complaint on Jan. 10 in the U.S. District Court for the Western District of Pennsylvania against Pennsylvania Association of Staff Nurses & Allied Professionals seeking to vacate an arbitration award.

According to the complaint, the plaintiff alleges that the arbitration opinion and award of Matthew M. Franckiewicz that required the plaintiff to pay duplicate wages for working on holidays is contradictory to the terms of a collective bargaining agreement between it and the defendant.

The suit states the union had filed a grievance on behalf of an employee who was paid the premium rate for the Christmas holiday in 2016 and was seeking to count those same hours toward overtime later in the workweek.

The plaintiff requests that the court vacate arbitrator Franckiewicz's Dec. 12, 2017, opinion and award. It is represented by Joseph F. Quinn of Cozen O'Connor in Pittsburgh.
