Man alleges Life Insurance Co. of North America unlawfully terminated long-term disability benefits

SCRANTON – A Harveys Lake Borough man alleges his claim for disability benefits was wrongfully terminated.

Leroy Spencer filed a complaint on Jan. 11 in the U.S. District Court for the Middle District of Pennsylvania against Life Insurance Co. of North America alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he received long-term disability benefit payments from the defendant from July 6, 2013, to July 5, 2015, when the defendant terminated payments. The suit states the defendant determined that the plaintiff was no longer disabled according to the terms of the policy.

The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly denied his benefits despite the fact that his physician diagnosed him as totally and permanently disabled.

The plaintiff seeks payment of long-term disability benefits due to him, interest, court costs and any further relief the court grants. He is represented by Bruce J. Phillips of Wetzel, Phillips, Rodgers & Falcone in Plains.
