Golden Living Centers - Pennsylvania seeks to vacate arbitration award in union dispute

PITTSBURGH – The operator of several nursing facilities in Pennsylvania is seeking to vacate an arbitration award in a dispute with a labor union.

Golden Living Centers - Pennsylvania filed a complaint on Dec. 29, 2017, in the U.S. District Court for the Western District of Pennsylvania against Service Employees International Union Healthcare Pennsylvania seeking to vacate an arbitration award.

According to the complaint, the plaintiff and defendant regularly entered into a collective bargaining agreements. A grievance arose between the two parties regarding the 2017 vacation payout and it proceeded into arbitration. In December 2017, and opinion and award was issued by arbitrator Matthew Franckiewicz.

The plaintiff alleges the award is "fatally flawed" and "fails to draw its essence from an agreement when it contradicts the express terms of the agreement," according to the suit.

The plaintiff seeks to vacate the award of Franckiewicz. It is represented by Charles M. Roesch of Dinsmore & Shohl LLP in Cincinnati, Ohio.
