PITTSBURGH – An Indiana, Pennsylvania man is seeking to vacate an award in a dispute over crop insurance.
Bradley Overdorff filed a complaint on Jan. 18 in the U.S. District Court for the Western District of Pennsylvania against Nau Country Insurance Co. seeking to vacate an arbitration award.
According to the complaint, the plaintiff operates a 150-acre farm in Indiana County and had crop insurance coverage with the defendant for his 2011 corn crop. He alleges he received a $13,417 indemnity payment as a result of the failure of the 2011 crop, but the Risk Management Agency notified the defendant that the plaintiff allegedly abandoned the crop and determined the defendant overpaid the plaintiff.
The suit states the dispute went into arbitration and the arbitrator granted the defendant's motion for summary judgment.
The plaintiff requests that the court vacate the final award. He is represented by Alexander H. Lindsay Jr. of The Lindsay Law Firm PC in Pittsburgh.
