HARRISBURG – A Matamoras man is seeking indemnification from his insurance company after he damaged utility lines with an excavator at his home.
Eric Stewart filed a complaint on Jan. 24 in the U.S. District Court for the Middle District of Pennsylvania against Travelers Insurance Co. alleging breach of contract and other counts.
According to the complaint, the plaintiff alleges that on Oct. 9, 2017, he caused a covered loss when he struck and pulled down multiple utility lines owned by Pike County Light and Power with an excavator. He alleges he made a claim with the defendant seeking defense and indemnification under his homeowners insurance policy but the defendant has refused to provide coverage.
The plaintiff holds Travelers Insurance Co.'s refusal to provide coverage is allegedly without reasonable basis in fact and/or law.
The plaintiff seeks compensatory damages, interest, punitive damages, court costs and any further relief the court grants. He is represented by Jason R. Ohliger of Weinstein, Zimmerman & Ohliger in Milford.
