HARRISBURG – An Ohio man alleges he was injured at a Pennsylvania rail yard because of a fall.
David Massaro filed a complaint on Jan. 24 in the U.S. District Court for the Middle District of Pennsylvania against Norfolk Southern Corp., doing business as Norfolk Southern Railway Co., citing the Federal Employers' Liability Act.
According to the complaint, the plaintiff was working for the defendant at the Harrisburg yard on Feb. 22, 2017. He alleges he was walking across the track in a poorly lit area, stepped on a discarded brake shoe and fell, causing him to fracture his right wrist.
The plaintiff holds Norfolk Southern Corp. responsible because the defendant allegedly failed to properly illuminate the track where the plaintiff was working and properly remove or discard brake shoes from the area.
The plaintiff seeks judgment against the defendant in an amount that exceeds $150,000. He is represented by Michael J. Olley and Lawrence A. Katz of Coffey Kaye Myers & Olley in Bala Cynwyd.
