Former Export Now Inc. officer alleges he is owed unpaid wages

PHILADELPHIA – A Philadelphia man alleges an Akron, Ohio company failed to pay him wages due after he was terminated.

Joseph A. Rosamilia filed a complaint on Jan. 29 in the U.S. District Court for the Eastern District of Pennsylvania against the Export Now Inc. and Frank L. Lavin citing the Pennsylvania Wage Payment and Collection Law.

According to the complaint, the plaintiff states the defendants promised to pay him a base salary of $180,000 and a 3 percent equity interest in the company to induce him to become chief financial officer of Export Now in 2011. He states in November 2011, he was asked to take on the additional role of assistant treasurer for an additional $1,000 per month, but his salary was never increased. He also alleges he was never converted from independent contractor to employee.

The suit states the plaintiff was terminated in January 2015 without notice.

The plaintiff holds Export Now Inc. and Lavin responsible because the defendants allegedly failed to pay the wages it admitted was due to him after his termination.

The plaintiff requests a trial by jury and seeks declaration that the defendants fraudulently induced the plaintiff to enter an agreement, award damages to the plaintiff, liquidated damages, court costs, interest, compensatory damages, punitive damages and any further relief the court grants.
