SCRANTON – A Honesdale business alleges a Newville limited liability company and individual are infringing its marks.
Steer Machine Tool & Die Corp. filed a complaint on Jan. 30 in the U.S. District Court for the Middle District of Pennsylvania against SS Nile Bottle Stoppers LLC and Ruth Niles alleging trademark infringement and other counts.
According to the complaint, the plaintiff alleges that the defendants have infringed on its word marks "by making direct copies or near identical copies" of its marks to compete with it.
The plaintiff holds SS Nile Bottle Stoppers LLC and Niles responsible because the plaintiff alleges it will be irreparably harmed unless the defendant's infringement is not enjoined.
The plaintiff seeks to enjoin the defendants, consequential damages, incidental damages, liquidated damages, court costs and any further relief the court grants. It represented by Brigid E. Carey in Scranton.
