Las Vegas man alleges Trans Union incorrectly marked him as deceased on credit report

PHILADELPHIA – A Las Vegas man alleges Trans Union has incorrectly listed him as deceased on his credit report.

Kenneth O'Neal Short filed a complaint on Feb. 2 in the U.S. District Court for the Eastern District of Pennsylvania against Trans Union LLC alleging violation of the Fair Credit Reporting Act.

According to the complaint, the plaintiff alleges that the defendant has listed him as deceased on his credit report since November 2017. He alleges because of this error, it has been impossible for him to obtain credit. 

The plaintiff holds Trans Union LLC responsible because the defendant allegedly failed to independently verify that a consumer is deceased before adding the notion to a consumer's report.

The plaintiff requests a trial by jury and seeks actual damages, statutory damages, punitive damages, court costs and any further relief this court grants. He is represented by Mark D. Mailman and Joseph L. Gentilcore of Francis & Mailman PC in Philadelphia.
