PHILADELPHIA – A Grand Rapids, Michigan consumer alleges he has been unable to obtain credit because a credit bureau incorrectly has him listed as deceased.

Donta McLaster filed a complaint on Feb. 2 in the U.S. District Court for the Eastern District of Pennsylvania against Trans Union LLC alleging violation of the Fair Credit Reporting Act.

According to the complaint, the plaintiff alleges the defendant has erroneously listed him as deceased on his credit report since September 2017. He alleges it has been impossible for him to obtain credit because of this error.

The plaintiff holds Trans Union LLC responsible because the defendant allegedly failed to investigate the information received regarding the deceased notation.

The plaintiff requests a trial by jury and seeks actual damages, statutory damages, punitive damages, court costs and any further relief the court grants. He is represented by Mark D. Mailman and Joseph L. Gentilcore of Francis & Mailman PC in Philadelphia.
