Johnstown Construction Services alleged to owe more than $30,000 to union plan

PITTSBURGH – A Johnstown employer is alleged to have failed to pay contributions to employee fringe benefit plans.

Laborers' Combined Funds of Western Pennsylvania filed a complaint on Feb. 2 in the U.S. District Court for the Western District of Pennsylvania against Johnstown Construction Services LLC citing the Employee Retirement Income Security Act and the Labor-Management Relations Act.

According to the complaint, the plaintiff alleges that the defendant has failed to pay wage deductions and fringe benefit contributions in violation of their bargaining agreement.

The plaintiff holds Johnstown Construction Services LLC responsible because the defendant allegedly failed to make timely payments of principal contributions and wage deductions from June to December 2017.

The plaintiff seeks to enjoin the defendant, order the defendant to file a complete and accurate remittance reports, order the defendant to present for an audit, monetary judgment in the sum of $34,017.31 plus additional amounts, interest, liquidated damages, late charges, court costs and any further relief the court grants.
