HARRISBURG – A Mexican citizen formerly employed by a York restaurant alleges he is owed unpaid wages.
Gerardo Ramirez Macedo filed a complaint on Feb. 9 in the U.S. District Court for the Middle District of Pennsylvania against Toltecos Inc., Manuel Palacios and David Carrillo alleging violation of the Fair Labor Standards Act, the Pennsylvania Minimum Wage Act and the Pennsylvania Wage Payment and Collection Law.
According to the complaint, the plaintiff alleges that he worked as a preparation cook and table busser for the defendants' Guadalajara Authentic Mexican Restaurant from January 2014 to May 2017 while he resided in York.
The plaintiff holds Toltecos Inc., Manuel Palacios and David Carrillo responsible because the defendants allegedly failed to pay the plaintiff a minimum wage and failed to pay overtime premiums for hours worked over 40 in a workweek.
The plaintiff seeks actual unpaid wages, liquidated damages, disgorgement of funds, punitive damages, court costs and any further relief the court grants. He is represented by Chelsea Edwards and Liz Maria Chacko of Friends of Farmworkers in Philadelphia.
