Mike Bevilacqua Sheet Metal Inc. alleged to owe more than $90,000 to trust funds

HARRISBURG – A Scranton employer is alleged to have failed to pay contributions to several trust funds.

Warren Faust and Lori Eshenaur, as trustees of the Sheet Metal Workers Local 44 Retirement Income Plan, et al. filed a complaint on Feb. 9 in the U.S. District Court for the Middle District of Pennsylvania against Mike Bevilacqua Sheet Metal Inc. citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that the defendant has failed to pay timely amounts due under the collective bargaining agreement between the two parties. The plaintiffs allege the defendant is delinquent for the period of November 2014 to January 2018.

The plaintiffs seek contributions of at least $92,319.65, any additional contributions, liquidated damages, interest of at least $60,500.55, court costs and any further relief the court grants. They are represented by Charles W. Johnston of Charles W. Johnston PC in Camp Hill.
