Woman alleges Unum Life Insurance Co. of America unlawfully terminated disability benefits

HARRISBURG – A Gibsonia woman alleges her long-term disability benefits were wrongfully terminated.

Kathy Obermeier filed a complaint on Feb. 8 in the U.S. District Court for the Western District of Pennsylvania against Unum Life Insurance Co. of America alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she became disabled due to having sarcoidosis. The suit states she applied for and received long-term disability benefits and life insurance coverage from the defendant until it denied the benefits in June 2017 on the allegations that she is able to perform the material duties of her regular occupation.

The plaintiff holds Unum Life Insurance Co. of America responsible because she alleges her medical conditions prevent her from performing the duties of any occupation.

The plaintiff seeks declaration that the defendant is obligated to pay the plaintiff disability benefits, court costs and any further relief the court grants. She is represented by Gregory G. Paul of Morgan & Paul PLLC in Pittsburgh.
