Woman claims Life Insurance Co. of North America failed to conduct full review of claim

PITTSBURGH – A Monaca resident alleges her long-term disability benefits were wrongfully terminated.

Donna Schooley filed a complaint on Feb. 9 in the U.S. District Court for the Western District of Pennsylvania against Life Insurance Co. of North America alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff was formerly employed by Preservation Technologies as a shipping clerk and stopped working in 2012 because of medical conditions. The suit states the defendant awarded her long-term disability benefits in April 2013 and that her benefits were terminated Oct. 26, 2015. She alleges the Social Security Administration found her disabled as of November 2012.

The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly terminated plaintiff's disability benefits based on its claim that she is no longer disabled according to the terms of the plan and did not conduct a full and fair review of her claim.

The plaintiff seeks declaration that she is entitled to the relief under ERISA, interest, court costs and any further relief the court grants. She is represented by Brian Patrick Bronson of QuatriniRafferty PC in Greensburg.
