PHILADELPHIA – A Delaware company alleges it was provided unreliable equipment by a Maryland company.
US Bortek LLC filed a complaint on Feb. 12 in the U.S. District Court for the Eastern District of Pennsylvania against Vermeer Mid Atlantic LLC alleging breach of contract and other counts.
According to the complaint, the plaintiff was hired as a subcontractor for a Sunoco Pipeline project in June 2017 and the plaintiff entered into two contracts with the defendant in July 2017 to rent equipment and supplies. The plaintiff alleges the defendant's equipment repeatedly failed and was inoperable.
The plaintiff holds Vermeer Mid Atlantic LLC responsible because the defendant allegedly failed to provide reliable and adequate drilling equipment.
The plaintiff seeks judgment against the defendant for damages, injunctive relief, interest, court costs and any further relief the court grants. It is represented by Philip E. Hinerman and Mark J. Fanelli of Fox Rothschild LLP in Philadelphia.
