PHILADELPHIA – A Hatfield woman is seeking reinstatement of her long-term disability benefits.
Virginia C. Mastromatto filed a complaint on Feb. 12 in the U.S. District Court for the Eastern District of Pennsylvania against The Lincoln National Life Insurance Co. alleging violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that she became disabled due to the effects of failed surgery and treatments of trigeminal neuralgia. The suit states she filed a claim with the defendant in July 2015 for disability benefits, received short-term disability benefits and was approved for long-term disability benefits starting October 2015. The suit states the benefits were later terminated.
The plaintiff holds The Lincoln National Life Insurance Co. responsible because the defendant allegedly refused to pay plaintiff's disability benefits despite having sufficient medical proof to prove her disability.
The plaintiff seeks award the plaintiff full and complete payment of long-term disability benefits under the policy, interest, all ancillary benefits due, court costs and any further relief the court grants. She is represented by Michael J. Burns of Bowen & Burns in Southampton.
