PHILADELPHIA – A New York resident alleges two credit bureaus have mixed his credit file with that of a family member.
Joshua Allen Hurst filed a complaint on Feb. 15 in the U.S. District Court for the Eastern District of Pennsylvania against Trans Union LLC and Equifax Information Services LLC citing the Fair Credit Reporting Act.
According to the complaint, the plaintiff alleges that since March 2017, the defendants have been reporting inaccurate information on his credit report. He alleges his credit file has been mixed with his brother's file, who has a similar name. He alleges he has lost credit opportunities and sustained harm to his credit reputation and score because of the defendants' actions.
The plaintiff holds Trans Union LLC and Equifax Information Services LLC responsible because the defendants allegedly failed to employ and follow reasonable procedures to assure accuracy of his credit report.
The plaintiff requests a trial by jury and seeks actual damages, statutory damages, punitive damages, court costs and any further relief the court grants. He is represented by Mark D. Mailman and Alexis I. Lehmann of Francis & Mailman PC in Philadelphia.
