Couple alleges they were damaged when Wheeler, Wolfenden & Dawares PA failed to prepare tax returns

PHILADELPHIA – A Unionville couple alleges a Delaware accounting and professional service firm failed to prepare their taxes for two years.

Russell Dixon Thayer and Gail B. Thayer filed a complaint on Feb. 15 in the U.S. District Court for the Eastern District of Pennsylvania against Wheeler, Wolfenden & Dawares PA and David Wolfenden alleging breach of contract, negligence and breach of fiduciary duty.

According to the complaint, the plaintiffs hired the defendants in 2007 to provide financial services. The plaintiffs allege the defendants failed to prepare and file their 2013 and 2014 personal tax returns even though the defendants were paid for their services. They allege they had to pay alternative professionals to prepare the missing returns and were required to pay interest on loans.

The plaintiffs seek judgment against the defendants in an amount of more than $75,000 plus interest, court costs, punitive damages and any further relief the court grants. They are represented by Matthew Weisberg of Weisberg Law in Philadelphia and Gary Schafkopf of Schafkopf Law LLC in Bala Cynwyd.
