Mercik Unlimited Inc. employee alleges she is owed unpaid overtime wages

PITTSBURGH – A Kittanning woman alleges her employer has not paid her at the correct rate for her overtime work.

Brenda Blystone filed a complaint on Feb. 15 in the U.S. District Court for the Western District of Pennsylvania against Mercik Unlimited Inc. alleging violation of the Federal Labor Standards Act and the Pennsylvania Wage Payment and Collection Law.

According to the complaint, the plaintiff worked at the defendant's grocery store in Homer City and has been employed as the deli manager for more than a year. She alleges she regularly works more than 40 hours per week but was not paid at the appropriate rate for overtime work.

The plaintiff holds Mercik Unlimited Inc. responsible because the defendant allegedly paid her overtime wages at a half time rate instead of time-and-a-half of her regular rate.

The plaintiff seeks unpaid wages, liquidated damages, court costs all damages and any further relief the court grants. She is represented by Robert A. Bracken of Bracken Law Firm LLC in Pittsburgh.
