Theatre Historical Society of America files suit over alleged unlawful use of Hollywood Theater mark

PITTSBURGH – A Pittsburgh nonprofit alleges another nonprofit in the state is unlawfully using a trademark.

Theatre Historical Society of America and Joseph Masher filed a complaint on Feb. 22 in the Court of Common Pleas of Allegheny County against Friends of the Hollywood Theater alleging trademark infringement and other counts.

According to the complaint, the plaintiffs allege that the defendant is using the Hollywood Theater mark and that it is likely to cause confusion regarding the operator of the Hollywood Theater.

The plaintiffs seek award of economic and punitive damages, interest court costs and any further relief this court grants. They are represented by Andrew J. Horowitz of Obermayer Rebmann Maxwell & Hippel LLP in Pittsburgh and by Abigail Salisbury of Salisbury Legal in Pittsburgh.
