Highland Park Care Center resident alleges center failed to protect her from fall

PITTSBURGH – A Pittsburgh woman has filed suit against a health care facility after fracturing her hip in a fall.

Sheila Vegamartinez, by and through her attorney in fact Cynthia Murray, filed a complaint on Feb. 21 in the Court of Common Pleas of Allegheny County against Highland Park Care Center LLC, operating under the fictitious name Highland Park Care Center, alleging negligence.

According to the complaint, Vegamartinez was admitted to the defendant's care center in September 2016 at the age of 61. The suit states she fell in February 2017 and suffered a hip fracture while under the defendant's care.

The plaintiff holds Highland Park Care Center LLC responsible because it failed to ensure that comprehensive and appropriate care plans regarding Vegamartinez's risk for falls were implement and failed to protect her from physical harm and neglect.

The plaintiff requests a trial by jury and seeks judgment against the defendant for compensatory damages, consequential damages, court costs, interest and any further relief the court grants. She is represented by Mark D. Troyan of Robert Peirce & Associates PC in Pittsburgh.
