Man alleges he is entitled to underinsured motorist benefits from State Auto Insurance

PITTSBURGH – A Pittsburgh man is seeking underinsured motorist benefits from his insurer over injuries he sustained in a collision.

Bernard Weiss filed a complaint on March 1 in the Court of Common Pleas of Allegheny County against State Auto Insurance Cos. alleging breach of contract.

According to the complaint, the plaintiff alleges that on May 6, 2016, he sustained physical injuries and damages to his property when he was struck by an underinsured motor vehicle. The suit states the plaintiff was insured by the defendant at the time and that the insurance policy of the driver that struck him was not adequate to compensate him for his injuries.

The plaintiff holds State Auto Insurance Cos. responsible because the defendant allegedly failed to pay the plaintiff underinsured motorist benefits.

The plaintiff seeks judgment against the defendant for underinsured motorist benefits in an amount that exceeds the compulsory arbitration limits and any further relief the court grants plus court costs. He is represented by Jaclyn M. Gibson of Flaherty Fardo LLC in Pittsburgh.
