PITTSBURGH – A patron of a Pittsburgh establishment alleges he was assaulted by a man while there and is seeking damages.

Justin Townsend filed a complaint on March 5 in the Court of Common Pleas of the Allegheny County against Down the Road Lounge, Garf Inc. and John Anthony Nash citing the Dram Shop Act and assault and battery.

According to the complaint, the plaintiff alleges that on July 21, 2017, he was struck in the face with a beer mug by Nash, causing a fracture and severe laceration to his face.

The plaintiff holds Down the Road Lounge, Garf Inc. and Nash responsible because Down the Road Lounge and Garf allegedly provided alcohol to a person who was visibly intoxicated and Nash allegedly assaulted the plaintiff with the intentional desire to cause harm.

The plaintiff seeks judgment against the defendants for punitive damages, and any further relief the court grants. He is represented by James L. Welsh of The Welsh Law Group LLC in Murrysville.
