Mutual of Omaha Life Insurance Company accused of improperly terminating disability benefits

HARRISBURG — An individual is suing Mutual of Omaha Life Insurance Company for alleged breach of contract.

Jamie Eberhard filed a complaint on March 7 in the U.S. District Court for the Middle District of Pennsylvania, alleging that the defendant terminated his disability benefits despite still allegedly being disabled.

According to the complaint, the plaintiff alleges that he became disabled after he allegedly was attacked by his neighbor's dog, which allegedly caused disabling injuries, including left knee and hamstring injuries. The plaintiff holds the defendant responsible for allegedly granting disability benefits to him and then later terminating said benefits even though he allegedly was still disabled.

The plaintiff seeks judgment against the defendant and requests that he be granted ongoing disability benefits, payment of all past disability benefits, reimbursement for any lost medical benefits, court costs and any further relief this court grants.
