H & K Equipment alleges forklift it purchased is defective

PITTSBURGH – A Coraopolis company alleges it purchased defective equipment from an Illinois company.

H & K Equipment Inc. filed a complaint on March 8 in the Court of Common Pleas of Allegheny County against Illinois Left Equipment Inc. alleging breach of contract.

According to the complaint, the plaintiff alleges that in December 2017, it purchased a forklift from the defendant and that the defendant represented that it was in good working order and fully operable. The plaintiff alleges that upon delivery, it learned the forklift was defective, including failures in its transmission, brake system and engine. It alleges it contacted the defendant for a refund and the defendant refused.

The plaintiff seeks judgment against the defendant in the amount of $54,600 plus court cost. It is represented by Raymond P. Wendolowski Jr. of Bernstein-Burkley PC in Pittsburgh.
