PITTSBURGH – A customer at a Natrona Heights store alleges broken cement at the store's entrance caused him to fall.
Bryan Atkinson filed a complaint on March 9 in the Court of Common Pleas of Allegheny County against Big Lots Stores Inc., doing business as Big Lots, and Wild Blue Management LP alleging negligence.
According to the complaint, the plaintiff alleges that on Jan. 5, 2018, he sustained serious physical injuries when he tripped and fell at the defendants' Big Lots store because of poorly maintained cement near the entrance. He alleges he sustained a right knee partial tear of the anterior cruciate ligament at the femoral attachment and other injuries.
The plaintiff holds Big Lots Stores Inc. responsible because the defendant allegedly failed to fix the broken cement that was located at the entrance of their premises or provide adequate warning regarding its defective nature.
The plaintiff seeks judgment against the defendant in an amount of more than $35,000 plus any further relief the court grants. He is represented by Marc I. Simon of Simon & Simon PC in Pittsburgh.
