PHILADELPHIA — A man is suing The Prudential Insurance Company of America, Gaudenzia DRC Inc. and Gaudenzia DRC Inc. Short and Long Term Disability Insurance Plan for alleged breach of contract.
Darryl Smith filed a complaint on March 13 in the U.S. District Court for the Eastern District of Pennsylvania, alleging that the defendants refused to provide him with disability benefits.
According to the complaint, the plaintiff alleges that he became disabled due to several medical conditions, including vertigo, and applied for disability benefits, which allegedly were approved. The plaintiff holds the defendants responsible for allegedly terminating his disability benefits despite allegedly having sufficient medical proof to validate his claim.
The plaintiff seeks $110 per day in statutory penalties, pre-judgment interest on all statutory penalties, court costs and any further relief this court grants. He is represented by Adam Harrison Garner of The Garner Firm Ltd. in Philadelphia.
