United Refining Company accused of violating the Family and Medical Care Leave Act

PITTSBURGH — An individual is suing United Refining Company for allegedly violating the Family and Medical Leave Act.

Ronda S. Morrison filed a complaint on March 20 in the U.S. District Court for the Western District of Pennsylvania, alleging that the defendant terminated her employment for going on several FMLA-protected leaves.

According to the complaint, the plaintiff alleges that she requested FMLA leave in 2015 to undergo a gastric sleeve surgery. After the surgery and two subsequent FMLA-protected leaves, she filed for another leave due to other medical conditions, but she allegedly was fired instead. The plaintiff holds the defendant responsible for allegedly infringing on her rights under the FMLA.

The plaintiff requests a trial by jury and seeks exemplary damages, lost wages, back pay, front pay, lost fringe and other benefits, interest, court costs, liquidated damages and any further relief this court grants. She is represented by Arthur D. Martinucci of Quinn, Buseck, Leemhuis, Toohey & Kroto Inc. in Erie, Pa.
