Pennsylvania Air National Guard accused of retaliation

PITTSBURGH — An individual is suing the Pennsylvania Air National Guard and Adjutant General of Pennsylvania for alleged discrimination and retaliation.

David J. MacMillan filed a complaint on March 23 in the Court of Common Pleas of Allegheny County, alleging that the defendants retaliated against him.

According to the complaint, the plaintiff alleges that he had his retention of employment refused in retaliation for allegedly exercising his rights. The plaintiff holds the defendants responsible for allegedly taking action against him because he took certain steps to enforce his rights under the Uniformed Services Employment and Reemployment Rights Act of 1994.

The plaintiff seeks payment of back wages and benefits, compensatory and punitive damages, actual damages and any further relief this court grants. He is represented by Samual J. Cordes and Nicholas A. Krakoff of Rothman Gordon P.C. in Pittsburgh.
