PHILADELPHIA — Several labor union funds are suing W.E. Yoder Inc. for allegedly breaching a collective bargaining agreement.
The International Union of Operating Engineers of Eastern Pennsylvania and Delaware Pension Fund and several other union funds filed a complaint on April 9 in the U.S. District Court for the Eastern District of Pennsylvania, alleging that the defendant violated the Employee Retirement Income Security Act.
According to the complaint, the plaintiffs allege they suffered damages because the defendant allegedly failed to make contributions. The plaintiffs hold the defendant responsible for allegedly failing submit payments.
The plaintiffs request a trial by jury and seek judgment against the defendant for $12,453.03 in principal delinquent contributions, $466.55 in interest, $1,245.30 in liquidated damages, attorneys' fees, costs and any other relief the court finds just and proper.
